What is a Leave Policy?

A Leave Policy is a formal set of guidelines established by an organization to regulate employee time off.  It outlines the types of leave employees are entitled to, eligibility criteria, duration, notice requirements, and procedures for requesting and approving leave.  

In the UAE, leave policies are designed to balance employee well-being, personal needs, and organizational operational requirements. They cover annual leave, sick leave, maternity and paternity leave, Hajj leave, and other statutory entitlements, while allowing employers to include additional discretionary leave benefits to enhance employee satisfaction and retention. 

Key Types of Leave under UAE Labour Law 

Annual Leave 

  • Employees are entitled to 30 calendar days of paid leave per year after completing one year of continuous service. 
  • If an employee has not completed one year, they are entitled to two days of leave per month of service. 
  • Leave encashment is permitted for unused leave at the end of employment or as per company policy. 

Sick Leave 

  • Employees are eligible for up to 90 days of sick leave per year, subject to providing medical certificates. 
  • New hires are eligible after completing the probation period. Employees that are not done with probation can be granted unpaid leave based on medical reports from recognized institutions. 
  • The payment structure is typically as follows: 
    • First 15 days: Full pay 
    • Next 30 days: Half pay 
    • Remaining 45 days: Unpaid 
  • Sick leave beyond 90 days may require additional documentation and is generally subject to employer discretion. 

Maternity Leave 

  • Female employees are entitled to 60 days of maternity leave, with at least 45 days paid and 15 days half paid for full-time employees.  Leave can be taken before and after delivery, and extensions may be granted for complications with medical evidence.  
  • In the case the female employees get an illness resulting from the pregnancy or childbirth she may take an additional 45 days without pay. 
  • If the baby is disabled or sick the employee may take an additional 30 days of fully paid leave with room for extension of 30 unpaid leave days. 
  • Employers may also provide additional benefits such as flexible working arrangements or paid leave for prenatal check-ups. 

Paternity Leave 

Male employees are entitled to 5 days of paid paternity leave, which can be taken consecutively or separately, within a reasonable period following the birth of a child. 

Hajj Leave 

Muslim employees who have completed at least one year of service are entitled to 30 days of unpaid leave to perform Hajj pilgrimage once in their employment tenure. 

Other Types of Leave 

Emergency Leave: For urgent personal matters or family emergencies, granted at the discretion of the employer. 

Compassionate Leave: An employee is entitled to 5 days of leave for loss of spouse and 3 days for loss of parent, child, sibling, grandchild or grandparent. 

Special Leave/Discretionary Leave: Companies may introduce additional leave benefits as part of employee wellness programs or incentives. 

Study Leave: A student enrolled in an accredited institution in the UAE is entitled to 10 days pf paid leave to sit for examinations. They must have completed at least two tears of services in the company.
